TERMS AND CONDITIONS:

Acceptance of Terms: These Terms and Conditions govern your access to and use of the Retilda Property Enterprise website and mobile application (“the Platform”). By accessing or using the Platform, you agree to be bound by these terms in full. If you do not agree to these terms, you must refrain from accessing or using the Platform.

Services Offered: The Platform provides access to electronic and household equipment, including but not limited to appliances, gadgets, and accessories. Users may browse, purchase, and/or inquire about products and services offered by Retilda Property Enterprise through the Platform.

Account Registration: Some features of the Platform may require users to create an account. By registering, users agree to provide accurate and complete information and to keep their account credentials secure. Users are solely responsible for any activity conducted through their accounts.

Eligibility Criteria: To qualify for subscription into the Installment Plan, a buyer must meet the following conditions:

1. Registration as a buyer with Retilda Property Enterprise.
2. Attainment of 18 years of age or older..
3. Ability to enter into a legally binding contract.
4. Must be a Nigerian citizen and resides in Nigeria
5. Provision of a valid delivery address within Nigeria.
6. Residency or employment at an electronically verifiable address
7. Possession of a valid and verifiable email address and mobile telephone number.
8. Registration and electronic verification of any of the following:

• National Identification Card displaying the National Identification Number (NIN) of the holder.
• Bank Verification Number (BVN).

1. Authorization as a holder of an eligible Naira debit/MasterCard or another valid payment card, with the authority to utilize the provided payment method.
2. Consent to the addition of payment card details to the account for payment automation.

Product Information: Retilda Property Enterprise endeavors to provide accurate and up-to-date product information on the Platform. However, we do not guarantee the accuracy, completeness, or reliability of product descriptions, pricing, availability, or other details. Users should exercise discretion and verify information before making purchasing decisions.

Ordering and Payment: Orders placed through the Platform are subject to acceptance and confirmation by Retilda Property Enterprise. By placing an order, users agree to pay the specified price for the selected products, including any applicable taxes and fees. Payment processing is conducted through secure channels, and users agree to provide accurate payment information.

Item(s) in Retilda Property Enterprise catalogue are to be purchased on installment however a buyer who desires to buy out rightly may choose the one-off payment

The installment plan allows a buyer to pay for an item for a specified period depending on the worth of the product.

Specified Period for Payment

Goods worth 6k – 15k: 1 month

Goods worth 16k – 30k: 2 months

Goods worth 31k – 60k: 3 months

Goods worth 61k – 100k: 4 months

Goods worth 101k – 150k: 5 months

Goods worth 151k – 250k: 6 months

Goods worth 251k – 400k: 8 months

Good worth 401k – 600k: 10 months

Goods worth 601k – 1M: 1 year

A customer can decide to pay weekly or monthly. A customer is expected to make 60% payment at the midpoint of the duration of the product’s worth.

All orders for purchase are subject to approval by Retilda Property Enterprise Team

A buyer who decides to change his/her chosen product before delivery shall reach out to Retilda Property Enterprise Management via our agent

The price payable on Item(s) purchased on Installment Plan shall be the current price of the Item(s) as listed on the Retilda Property Enterprise Catalogue as at the midpoint of the installment plan duration when delivery is being processed and not as at the date the order was made by the Buyer (s)

Buyer(s) may make payment any time before the due date; however, payments will be automatically attempted on the scheduled dates from a buyer’s registered card, where a Buyer(s) fails to process installment payment on or before the due date.

Buyer(s) who fail to consistently pay the installment sum as and when due shall not be entitled to delivery of ordered item(s) until the full purchase price is completely paid up. For the avoidance of doubt, a Buyer who fails to make payment consistently can only request for delivery after paying the last installment sum, and Retilda Property Enterprise reserves the right not to honour any request for delivery made by such Buyer(s) before paying the last installment, and to delay the delivery of the ordered Item(s) until the last installment has been paid by the Buyer(s).

Shipping and Delivery: Retilda Property Enterprise aims to fulfill orders promptly and deliver products within 10 working days from the midpoint of the duration of the good’s worth. However, delivery times may vary depending on factors beyond our control, such as shipping carriers and logistical constraints. Users are responsible for providing accurate shipping information to facilitate smooth delivery.

A buyer is entitled to the delivery of his/her product in ten (10) working days from the midpoint of the duration of the good’s worth if and only when

• 60% payment for the product has been made
• The payment was made according to the duration stipulated for the worth of item being purchased and no default in payment whatsoever

The price payable on Item(s) purchased on Installment Plan shall be the current price of the Item(s) as listed on the Retilda Property Enterprise Catalogue as at the midpoint of the installment plan duration when delivery is being processed and not as at the date the order was made by the Buyer (s)

If the ordered item(s) becomes unavailable by the midpoint of the selected installment plan, where at least 60% of the sales price has been paid, buyers will be asked to select alternative item(s) from a list within the same range or category available on the Retilda Property Enterprise Catalogue. Alternatively, buyers may opt to wait for a certain period during which Retilda Property Enterprise will make reasonable efforts to obtain the ordered item(s) for delivery, adhering to Retilda Property Enterprise’s delivery policies.

In the event that ordered item(s) has been delivered and a buyer fails to process installment payment on or before the due date, a late fee charges of 10% of the amount left i.e the balance that is yet to be paid will become applicable.

There shall be no limit to late fee payable in the event that ordered item(s) has been delivered.

For all intent and purposes, Buyer(s) are deemed as lessees of the delivered item(s) with a right to purchase same and the installment sum paid is deemed as rent payable for the use of such Item(s) until the full purchase price is fully paid up.

A Buyer who fails to complete the installment payment as and when due shall lose the right to purchase the affected Item(s) and shall become immediately obligated to return the Item(s) if already delivered to him/her.

Upon becoming obligated to return the Item(s), Retilda Property Enterprise reserves the right to retrieve such Item(s) from the possession of such Buyer(s) without first seeking or obtaining the consent of the Buyer(s).

Retilda Property Enterprise shall be entitled to exercise the right of retrieval without making any recourse to court, or obtaining any court order, police order or any other administrative order whatsoever.

Retilda Property Enterprise may demand return of delivered Item(s) –

• Virtually by sending emails, sms or placing phone-calls to the Buyer(s), or
• Physically by sending Retilda Property Enterprise Recovery Agents to

visit the Buyer(s) designated address or location to demand a return of the delivered Item(s).

Upon demand by Retilda Property Enterprise, defaulting Buyer (s) hereby agrees to promptly return all affected Item(s) to Retilda Property Enterprise’s office designated for such returns within 48 hours of demand by email or phone call, or the Buyer(s) shall immediately deliver the affected Item(s) to Retilda Property Enterprise Recovery Agents upon the Recovery Agents visit the Buyer’s designated address for such recovery.

Retrieved Items shall be sold as fairly used item and 70% of the amount realized shall be refunded back to the defaulted customer.

Returns and Refunds: Product being purchased cannot be swapped for cash. In a situation where it is considered 20% of the product’s worth will be deducted from the total sum paid.

A product delivered cannot be changed for another product.

In the event that ordered item(s) has been delivered and a buyer fails to process installment payment on or before the due date, the following late fee charges shall become applicable

Retilda Property Enterprise reserves the right to refuse returns or refunds that do not comply with our policy. Return shipping costs may apply unless otherwise specified.

Intellectual Property: All content, including but not limited to text, images, logos, and trademarks, displayed on the Platform is owned or licensed by Retilda Property Enterprise and is protected by copyright and other intellectual property laws. Users agree not to reproduce, distribute, or modify any content without prior authorization from Retilda Property Enterprise.

Privacy Policy: Our Privacy Policy governs the collection, use, and protection of user information on the Platform. By using the Platform, users consent to the collection and processing of their personal data in accordance with this policy. Retilda Property Enterprise is committed to safeguarding user privacy and complying with applicable data protection laws.

Limitation of Liability: To the fullest extent permitted by law, Retilda Property Enterprise shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of the Platform or the purchase of products, including but not limited to loss of profits, data, or goodwill. Users acknowledge and agree that their use of the Platform is at their own risk.

Governing Law and Dispute Resolution: These Terms and Conditions shall be governed by and construed in accordance with the laws of Nigeria. Any disputes arising from these terms shall be resolved through arbitration or mediation in Nigeria with each party bearing its own costs and attorney fees.

Changes to Terms: Retilda Property Enterprise reserves the right to modify or update these Terms and Conditions at any time without prior notice. Users will be notified of any changes, and continued use of the Platform constitutes acceptance of the revised terms.

By accessing or using the Retilda Property Enterprise website or mobile application, you acknowledge that you have read, understood, and agree to be bound by these extensive Terms and Conditions. If you do not agree to these terms, please refrain from using the Platform.

DISCLAIMER:

Retilda Property Enterprise does not engage in manufacturing any products whatsoever. Therefore, no items listed in the Retilda Property Enterprise Catalogue have been manufactured, produced, or assembled by Retilda Property Enterprise. Retilda Property Enterprise will not be held liable to any buyer(s) for errors, defects, or damages incurred as a result of using or coming into contact with any such items purchased from Retilda Property Enterprise. The descriptions of all items listed in the Retilda Property Enterprise catalogue are provided by the respective manufacturers, who are responsible for any errors, defects, or damages suffered by users according to their individual terms and conditions of liability.
